Legal Factors

All employees have a duty to present themselves at work on time, ready, willing and able to perform their job. This means reporting to work in a fit state when required.

Under the prevailing H&S legislation, all employees have a statutory duty to ensure that no action or inaction on their part causes harm to themselves or any other person. This means an employee who arrives at work or becomes unfit for any reason (physical or mental) may constitute a safety hazard to themselves and/or other persons and therefore must not be allowed to start work or continue working until in a fit condition to do so.
